A local court today granted bail to a senior resident doctor of the Government Medical College and Hospital (GMCH), Sector 32, in a case of alleged sexually harassment of three junior resident doctors.The court of Additional District and Sessions Judge granted bail to Dr Aniket Saini after he furnished bail bond of Rs 1 lakh. A case under Sections 354A (sexual harassment) and 354B (assault or use of criminal force to woman with intent to disrobe) of the IPC was registered against Dr Saini at the Sector 34 police station on the complaint submitted by the office superintendent of the Director-Principal, GMCH-32, on December 6.

According to information, Dr Saini, a senior resident (Medicine), allegedly misbehaved with two women and one male doctors on December 6.In their complaint submitted to the hospital authorities, three junior resident doctors had alleged that Dr Saini came to the medicine OPD and misbehaved with them and obstructed them from discharging their duties on December 6.They alleged that the accused used abusive language at a time when other staff was present. They further alleged that Dr Saini dragged one of them by holding her arms. Later, the accused threw a bowl on a wall, which hit the complainants.After verifying the complainant, the hospital authorities decided to lodge an FIR and sent the complaint to the police.Dr Saini was arrested by the police on December 8 and since then he was in judicial custody.

Section 354A of Indian Penal Code:

  1. A man committing any of the following acts—
  2. physical contact and advances involving unwelcome and explicit sexual overtures; or
  3. a demand or request for sexual favours; or

iii. showing pornography against the will of a woman; or

  1. making sexually coloured remarks, shall be guilty of the offence of sexual harassment.
  2. Any man who commits the offence specified in clause (i) or clause (ii) or clause (iii) of sub-Section (1) shall be punished with rigorous imprisonment for a term which may extend to three years, or with fine, or with both.
  3. Any man who commits the offence specified in clause (iv) of sub-Section (1) shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.

Section 354B of Indian Penal Code:

Any man who assaults or uses criminal force to any woman or abets such act with the intention of disrobing or compelling her to be naked, shall be punished with imprisonment of either description for a term which shall not be less than three years but which may extend to seven years, and shall also be liable to fine.

The doctor accused of misconduct with female colleagues has tendered his resignation to authorities at Government Medical College and Hospital in Sector 32, Chandigarh. His response to the show-cause notice on findings of the internal inquiry committees, Dr Aniket Saini, a senior resident at the hospital’s medicine department, has filed his response in which he has said he wishes to discontinue his services. The doctor, who is currently under suspension, had allegedly misbehaved with three doctors on duty, including two female colleagues on December 6, 2019, on the hospital premises.
